Montage for Ag, Inc., a California corporation (“Montage,” “we,” “us,” or “our”) is committed to respecting your privacy. Your ability to make informed decisions about your information is important to us. We do not share, rent or sell your Personal Information to any third-party, except as expressly set forth in this Privacy Policy (the or this “Policy”).
This Policy applies to (i) the website located at www.montageforag.com and other affiliated sites that we may choose to include at a later time (individually, each a “Site,” and collectively, the “Sites”), (ii) the services provided by Montage as described at www.montageforag.com/features, or other link that Montage may designate (the “Services”), and (iii) Montage’s proprietary online platform (the “Montage Platform”).
This Policy is intended to inform you about the kind of information, including Personal Information and Anonymous Information (as each is defined below) that we may collect from you when you access and use the Site, Services, Montage Platform or other services provided by us, and how we use that information and for what purpose. It also informs you about the ways in which you can control how we use and protect your information. This Policy is a part of and incorporated into the Montage’s Terms of Service located here. If any provision of this Policy is inconsistent or conflicts with any provision in the Agreement, this Policy will control with respect to the subject matter hereof. Capitalized terms used in this Policy but not defined in this Policy have the meanings given to them in the Agreement.
1. You Give Us Consent
1.1 Consent and Acceptance. Please read this Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use or access the Site, Services or Montage Platform. BY ACCESSING OR VIEWING THE SITE OR ACCESSING OR USING THE SERVICES OR MONTAGE PLATFORM, YOU AGREE TO THE TERMS OF THIS POLICY AND YOU EXPRESSLY CONSENT TO THE COLLECTION, USE, AND DISCLOSURE OF YOUR PERSONAL INFORMATION AND ANONYMOUS INFORMATION IN ACCORDANCE WITH THIS POLICY. You understand that by providing us Personal Information, you allow us to identify you.

2. Personal Information Vs. Anonymous Information
2.1 “Personal Information” means personally identifiable information of a living individual that allows someone to identify or contact you, as well as any other non-public information about you that is associated with or linked to any of the foregoing, and can include, for example, an individual's first and last name, phone number, and e-mail address.
2.2 “Anonymous Information” means data that is not associated with or linked to your Personal Information; Anonymous Information does not, by itself, permit the identification of individual persons.
3. Protecting Your Privacy
We do not share, rent or sell your account information to any third party, except as expressly set forth in this Privacy Policy. Please help us protect your privacy by keeping your account information safe. Do not disclose your account password or login information to anyone and change it periodically. 4. Information We Collect and How We Use It
We collect Personal Information and Anonymous Information, as described below. We use information that we collect to provide the Services, fulfill your requests, improve our Services, contact you, conduct research, create reports for internal use, and in the manners described below.
4.1 Registration Information. When you register an account with the Services, you are required to provide us Personal Information. We collect and store the following Personal Information in connection with the registration of an account: your first name, last name, and email address. We use your Registration Information to set up, maintain and track your account and provide you the Services.
4.2 Third-Party Payment Processor. We do not process any payments or store any payment information; however, when you submit payment for access and use of the Site, Services, and/or Montage Platform our third-party payment processor (currently, Stripe) will collect, on our behalf, your name, billing address, and complete credit card information, or your bank account information, that enables us to receive your payment. We do not control Stripe or its payment processing services. You should read and understand Stripe’s Privacy Policy before making payments related to the Site, Services or Montage Platform.
4.3 Third-Party Integrations. If you use Third-Party Integrations with the Services, whenever you visit, access, use, or interact with any such Third-Party Integrations, we may receive information from the third-party operator of such Third-Party Integrations, including information about the actions you take using such Third-Party Integrations. We use this information to improve our Services and the interaction between our Services and Third-Party Integrations.
4.4 Feedback and Communications with Us. If you provide us Feedback or contact us via e-mail, we will collect your first and last name and e-mail address, any information requested in our Feedback or contact forms, as well as any other content included in the e-mail or Feedback you send to us. Any Feedback you provide will be governed by the Agreement. We may use Personal Information submitted in your communications to contact and respond to you.
4.5 Log File Information. When you view our Site, or access and use the Services or Montage Platform, our servers collect information such as your web request, IP address, browser type, and other browsing information. This information is used to improve our internal operations or software, improve the content of our software, notify users about updates to the Site, Services and Montage Platform, and improve the Site, Services and Montage Platform.
4.6 Cookies. We may use browser cookies or local storage to keep and track your information. A browser cookie is a small file placed on the hard drive of your computer. Certain features of the Site, Services or Montage Platform may use locally stored data to collect and store information about your preferences and navigation to, from and on the Site, such as session data. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of the Site, Services or the Montage Platform. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to the Site. You can remove cookies by following directions provided in your {00138664;2} Internet browser’s help file, provided, however, that by doing so, you may not be able to utilize the Site, Services, or Montage Platform or certain portions or functionality thereof.
4.7 Web Beacons. Pages within the Site, Services, Montage Platform and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs. pixel tags and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an e-mail and for other related website statistics (for example, recording the popularity of certain content and verifying system and server integrity).
4.8 Collection by Third-Party Tools. The Site, Services and Montage Platform may also contain third-party tracking tools from our service providers, an example of which includes Google Analytics. Such third-parties may use cookies and application programming interfaces on our Site or through the Services or the Montage Platform to enable them to collect and analyze user information on our behalf.
5. Disclosure of Your Information
We will share your Personal Information with third parties only in the ways that are described in this Policy. We consider this information to be a vital part of our relationship with you. There are, however, certain circumstances in which we may share your Personal Information with certain third-parties without further notice to you, as set forth below.
5.1 Service Providers. We may provide your information to third-party service providers who need the information to perform services for us. These third-party service providers are required not to use your Personal Information other than to provide the services requested by us.
5.2 Affiliates. To provide the Site, Services and Montage Platform, we may use the efforts of our affiliates, and any subsidiaries, joint ventures, or other companies, existing or formed in the future, under a common control (collectively, “Affiliates”). We may share some or all of your Personal Information with our Affiliates, in which case we will require our Affiliates to honor this Policy.
5.3 Business Transfers. As we develop our business, we might sell or buy businesses or assets. In the event we are acquired by or merged with a third-party, we reserve the right to transfer or assign the information we have collected from our users as a part of such merger, acquisition, sale, or other change of control. In an event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors’ rights generally, your Personal Information may be transferred by the trustee. If Montage or any of its Affiliates is acquired by or merged with a third-party, that thirdparty will possess the Personal Information in Montage’s or its Affiliate’s possession and will assume the rights and obligations regarding your Personal Information as described in this Policy.
5.4 Anonymous Information. We may create Anonymous Information records from Personal Information by excluding information (such as your name) that would otherwise make such data personally identifiable to you. We reserve the right to use and disclose Anonymous Information at our discretion.
5.5 Other Disclosures. Regardless of any choices you make regarding your Personal Information (as described below), we may disclose your Personal Information (i) to respond to subpoenas, warrants, court orders, lawful requests or legal process, (ii) to establish or exercise our legal rights or defend against legal claims or protect other users, (iii) in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, or as otherwise required by law, or (iv) to investigate, prevent, or take action regarding any violation of this Policy or the Agreement.
6. Changes, Deletion of Your Data, and Opting Out
If your Personal Information changes, or if you no longer desire to us to retain your Personal Information, you may correct, update, amend, or delete {00138664;2} certain information through the user-interface of the Services or Montage Platform. All other Personal Information may be corrected, updated, amended, or deleted by contacting us via email at [email protected]. We will retain your Personal Information for as long as needed to provide you the Site, Services or Montage Platform, or any information requested by you. Please note that even if you have asked us to delete your Personal Information or any associated data, as described above, we may be required to keep certain information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database, but may remain in our archives. In any event, we will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
7. Protection and Security
We use commercially reasonable physical, electronic, and procedural measures to safeguard your Personal information against loss, theft, and unauthorized use, disclosure, or modification, but no company, including us, can fully eliminate security risks connected to handling information on the Internet. For example, your Personal Information may be affected by actions outside of our control, such as computer “hacking” and physical theft. WE ARE NOT RESPONSIBLE FOR THIRDPARTY CIRCUMVENTION OF ANY PRIVACY SETTING OR SECURITY MEASURES ON THE SITE, SERVICES OR MONTAGE PLATFORM AND YOU ACKNOWLEDGE AND AGREE THAT YOU PROVIDE YOUR PERSONAL INFORMATION AT YOUR OWN RISK. 8. Children
We do not knowingly collect or maintain Personal Information from or about children under the age of thirteen (13) and the Site, Services and Montage Platform are not intended to be used by persons under thirteen (13). If you are under the age of thirteen (13), please do not use the Site, Services or Montage Platform at any time nor in any manner. If you find that we have Personal Information about anyone below thirteen (13) years of age on our website, please inform us via email at [email protected].
9. Third-Party Websites, Products, Services, Content, And Links
Please be aware that this Policy does not apply to third-party use of information collected through Third-Party Integrations or any third-party websites, products, services, or content or to links provided for the foregoing (collectively, “Third-Party Applications”) on our Site or through the Services or Montage Platform. Third-party providers of such Third-Party Applications and Third-Party Integrations may collect your Personal Information or other information (including, without limitation, via tracking technologies like cookies or web beacons) and use such information and anonymous information regarding your interaction with the Third-Party Integrations or Third-Party Application that they deliver and with which you interact. Your browsing and interaction on any Third-Party Integration or Third-Party Application, including those that have a link on our Site or through the Services or Montage Platform, are subject to that third-party's own rules and policies.
10. Changes to This Policy
We reserve the right, at any time and without notice, to add to, change, update, or modify this Policy to reflect changes to our information collection practices, simply by posting such change, update, or modification to the Site or notifying you through the Services or Montage Platform and without any other notice to you. If we make material changes to this Policy, we will notify you by posting the revised Policy on the Site. Any such change, update, or modification will be effective immediately upon posting on the Site. Your continued use of the Site after such notification of changes as described above will constitute your agreement to such changes. We encourage you to periodically review this page for the latest information on our privacy practices. If you object to any change, your sole recourse shall be to immediately cease using the Site, Services and Montage Platform.
